All reservation changes and cancellations are subject to a $100.00 fee.
To receive a full refund less the $100 cancellation fee: Guests must cancel at least 30 days prior check-in by sending an email from the email on the reservation only.
If guests cancel within 14-30 days prior check-in: Guest will be refunded 50% for all nights less the $100 cancellation fee.
If guests decides to cancel (or modify dates) within 14 days of check-in: Refunds & modifications to a reservation within 14 days are not available.
Refunds are not offered for inclement weather or illness within the date ranges listed above. If you are concerned about Covid-19, weather or a potential emergency affecting your upcoming reservation, we recommend purchasing Trip Insurance. We do not provide refunds if you decide to cancel after check-in.
To guarantee your Tofte Trails cabin reservation, the fee of your total stay will be charged to your credit card at the time you make your reservation. Must be 21+ years old to book and stay at Tofte Trails. You will receive an email confirmation once your reservation is complete. If you need to cancel your reservation, please email hello@toftetrails.com before the deadlines listed below to receive your refund, minus a $100 cancellation or change fee (please note: the cancellation request MUST be sent from the person/email on your reservation. Requests from other persons/emails will not be honored). Text and social media notifications of cancellations are not acceptable. Cabin Reservations are NOT transferrable to another party or person. Holidays and special events may have special deposit and/or cancellation requirements. Special conditions may apply during high-demand periods and special events. Cabins booked on Airbnb will be held to the cancellation policy associated with that Airbnb booking. Please refer to your specific Airbnb reservation for cancellation information.
Kindness for ALL:
Similar to our first cabin destination, Cuyuna Cove, (and all our properties) we require kindess to all at Tofte Trails and will not tolerate anything less. Be kind, patient and welcoming to ALL other guests & our small, hardworking team. Check in is at 4pm and check out no later than 11am to ensure we have enough time to properly clean and prepare your cabin.
Do you allow children?
Tofte Trails is an adults only property, perfect for couples, solo travelers, your pup or renting out all 5 cabins for a best friends getaway. Due to the nature of our cabins and the safety concerns of our property layout, Tofte Trails is adults ages 21+ only. This policy must be abided by, there are no exceptions. Thank you for your understanding and following by this policy. Please email us at hello@toftetrails.com with any additional questions. Please remember if you choose to not follow our policies you will be asked to leave without a refund. We are happy to recommend other accommodations that are safe and suitable for young children.

Tofte Trails is an idyllic getaway, providing guests with an adventurous and intimate atmosphere on Minnesota's stunning North Shore while also offering community elements and thoughtful spaces for incredible and unexpected human connection. It is the perfect destination for you and your loved one to slow down & reconnect or enjoy a much needed solo escape in nature while also having the opportunity to meet new people at our forest community spaces. It's also an incredible way to gather your close friends for adventures, conversation and quality time spent together. Our 5 cabins and land are strategically designed in a way where you can choose the coziness of your own cabin and/or embrace the community fire pit/picnic area and meet new people from around the world.
You will most likely see/hear other guests during your stay as our cabins are gathered in a unified way while also providing privacy. You may just leave your stay with new lifelong friends, reignite a special connection with a loved one and even discover what possibilities lie within from a much needed solo getaway.
* Please note, as with anywhere along the North Shore, you will hear traffic from Hwy 61 which runs the entire length of the shore next to Lake Superior.

Things can and possibly will go wrong...something we've learned from hosting guests for over a decade now and working in hospitality for over 20 years. However, we want to make it right! We work hard every day and care DEEPLY about your experience. If you have a question or need help with something, please REACH OUT to us! If we don't know about it, we won't have the opportunity to help. And, we love hearing from our guests, it makes our day!
We are a small business and are family owned:
Please note we are not a hotel with onsite or on-demand services, we run with a very small team but please remember we do have surveillance and cameras on the property. We are husband and wife built/owned & managed and couldn't do it without the incredible help of another amazing local couple for cleaning/managing all cabins, guests and our 17 acre property! Your stay will be self-check in (similar to an Airbnb experience), however, we are just a phone call away if you have any questions during your stay. There may be someone to come assist at certain times of the day, but please know we cannot guarantee immediate onsite assistance.
***4 Wheel Drive or All Wheel Drive vehicles needed during Winter months:
Typically, snow can come anywhere from October-mid April. Onion River Road up to us is only short distance off hwy 61. However, snow can come quickly and snow removal will not be as prompt as it is in a city. There are limited plows/people on the North Shore so please be patient and prepared for all weather. Per our cancellation policy above, refunds are not provided for inclimate weather. We do sand/salt but a melt and re-freeze can happen with only hours and we will not be able to keep ice from forming. We HIGHLY recommend purchasing YakTrax prior to your stay which are simple traction cleats that go onto the bottom of your boots for around $20 on Amazon. The entire North Shore can get slippery and our land slopes down to several cabins and even flat parking lots can get very slippery.
Our land & wildlife interactions:
We are located on 17 beautiful wooded acres. Please remember when staying up North and in the woods there is always chance for encounters with bugs, critters (squirrels, chipmunks and yes, Black Bears live here, too!) and other wildlife interactions in and around your accommodation, especially during change of seasons and rain/humidity. Always check the weather and pack accordingly to ensure the most enjoyable getaway on the North Shore. PLEASE properly store your food away IN your cabin and NOT outside or in your car or you will be inviting these critters and bears to Tofte Trails and your cabin.
Max Occupancy:
Our cabins are designed to sleep up to 2 adults. This is our max occupancy per cabin. Tofte Trails is a destination geared towards adults with several pet friendly cabins and also a non-pet friendly option . Tofte Trails reserves the right to ask you to leave without a refund if our rules/policies are not abided by. 1 well behaved dog is allowed (possible to have a 2nd but MUST be discussed AND approved on the phone prior to booking and have it documented from Tofte Trails via email confirming this approval) with an additional pet fee. No puppies permitted. The dog MUST be on your reservation or an additional fee (on top of the pet fee) will be charged upon arrival. Please see our ‘pets’ section below for full details before deciding to bring your dog.
Arrival Condition & Damage:
Please report any damage to your cabin within a half hour of checking in! Any damage not reported will be deemed your responsibly. Guests staying in our pet friendly cabins MUST read through all pet rules prior to bringing their dog or may be asked to leave without a refund.
PLEASE READ ALL PET RULES prior to booking with your dog. Please read the last paragraph which addresses our policy with Service Animals and Emotional Support Animals.
Tofte Trails reserves the right to ask you to leave without a refund and will not be allowed to book a future stay if the following pet policies are not abided by:
-We allow 1 well behaved & well trained dog per cabin reservation in a pet friendly cabin for an additional nightly rate. MUST be over 12 MONTHS OLD & fully trained. NO EXCEPTIONS.
-The dog must be crated if left alone in the cabin (please note: large crates do not fit well so be mindful of your dog's size). You will be asked to sign our pet agreement upon arrival and send us a photo of it along with a photo of your dog's crate. Dogs are not allowed to be left alone in a cabin for ANY amount of time. Please note: you are responsible for noting any damage within 1 hour of arrival or it will be deemed your responsibility. If you do not feel your dog can be well behaved, we ask you leave them with a sitter. Pet fees are non refundable.
Please note: If you attempt to bring your dog and he/she is NOT on the reservation you will be subject to a $200 fine in addition to the nightly pet rate or even asked to leave if you attempt to bring a dog into a non-dog friendly cabin. We hope to stay pet friendly for years to come, but in order to do so the following rules must be followed by our guests and pet owners:
• Your dog must be on the reservation and the pet fee paid prior to arrival (If supplied, any wool blankets are removed from the cabins for pet reservations).
• Dogs are NOT allowed on the beds unless the pet blanket we provide is covering the bed (be sure to bring their favorite cozy bed with!)
• Owners are required to pick up after the dog and properly dispose of the waste in the garbage bin. If waste is not picked up, you will be subject to an additional fee. We do have and security cameras on site.
• Dogs must never be left alone in cabin unless secured in a crate
• Please bring a dog towel to wipe dirty feet before entering the cabin
• Dogs must be on a 6ft leash on the property at ALL times. Absolutely NO exceptions.
• Dogs are not allowed to be left on the patio alone if you leave the cabin
• Owners must follow ALL posted signage rules for pets at nearby trails
***Please report any noticeable damage to your cabin within 1 hour of checking in.
If your dog is prone to barking or may chew/scratch anything in the cabin, we kindly ask that you leave them at home so we can continue to offer dog friendly accommodations. The credit card on file for your reservation will be charged for any damage. If your dog is barking, aggressive or disruptive to other guests we reserve the right to ask you to leave without refund.
Service Dog and Emotional Support Animal policy:
Emotional Support dogs are different than a trained & registered service animal.
Emotional Support dogs must abide by our pet rules and pet fee MUST be paid.
It would be our pleasure to host you and your service dog.
You will be asked to answer the following questions legally allowed by the ADA regarding your service dog:
1. Is the dog a service animal required because of a disability?
2. What work or task has the dog been trained to perform? We do not charge extra for a service dog.
Guest remains liable for any and all damage caused by people or service dog.
Under the ADA, service animals must be harnessed, leashed, or tethered, unless these devices interfere with the service animal’s work or the individual’s disability prevents using these devices. In that case, the individual must maintain control of the animal through voice, signal, or other effective controls. The animal must be under control of the handler at all times therefore never left alone at any time.
If we discover a guest has misrepresented a pet as a service animal, we reserve the right to seek financial restitution, report fraudulent claims to government authorities and to evict the guest(s) without further notice. In the latter case, there will be no right to a refund for the remainder of the booking.
In 2022, both Airbnb and the Airlines no longer treat Emotional Service Animals as Service Animals.
If you have an ESA, you can book a pet friendly property and pay the applicable pet fees.

Yes, we have free wifi for you to connect to in your cabin but we encourage as much time away from technology as possible during your stay :) Our cell service is limited at the property so if you want to stay connected we recommend using Whatsapp for texting/calling via Wifi. Better cell service can be reached just seconds from our property.
Want to switch it up and work from a local coffee shop?
There are also incredible coffee shops a just few minutes away. Coho Cafe and Bakery and Fika Coffee are two local options and we also love Java Moose in Grand Marais (2o minute drive).
We choose our 17 acre property because of its unmatched beauty overlooking Lake Superior but also because of its absolute prime location near globally ranked outdoor adventures!
We are located just off Onion River Road which leads up to famous Oberg Mountain. You may have already heard of Oberg Mountain as it is listed as one of the best places in the Midwest to view Fall colors from one of highest vantage points but also for its cross country skiing, snowshoeing and hiking.
From your cabin at Tofte Trails you'll be able to access Superior Hiking trail, endless nearby hikes, waterfalls, the Gitchi Gami paved trail, Britton Peak Mountain Biking trail head, Lutsen Mountains, Lutsen Golf, and so much more within just minutes from our land! You'll also be able to enjoy the privacy of our 17 acres. Grab your coffee in the morning and enjoy walking our property down to the bottom of our land to enjoy solitude and beautiful views of lake Superior. Private Adventure Gear Storage:
-Your cabin comes with its own attached, secure storage area for all your favorite outdoor adventure gear. Room for your bikes or your skis/snowboard, snowshoes and simply a great space to put extra stuff out of your way. You'll have a unique keyless entry code to use for your cabin and storage area. We provide 2 folding chairs, a cooler and a camp blanket to enjoy at the base of our land OR bring to any Lake Superior beach. These items must be returned to your cabin storage upon checkout.
Any suggestions on what should I pack?
- Cozy slippers
- A headlamp for late evenings or exploring at night. Or, simply to help see what you're cooking on the grill! Our patios do have lights as well. We DO provide a Coleman LED lantern for possible power outages or evening walks on our land.
- Extra lighter in case ours happens to go home with a previous guest or is running low.
- A backpack for extra water and snacks. Be sure to stay hydrated and pack lots of snacks for your adventures!
- Lots of layers. Check the weather before your stay to ensure you pack accordingly. The weather can change quickly on the North Shore. Rain jackets, waterproof boots, umbrellas, extra warm winter gear, hand warmers, etc.
- Umbrella
- Bug spray and sunscreen. Pack sun hats too.
- Traveling with your dog? Please pack extra towels to wipe their fur/feet before they come back into the cabin. Make sure you have their crate with and their favorite doggie bed. Dogs are not allowed on the bed for any reason and must be crated if left alone in the cabin for ANY amount of time.
- Pack your favorite food for the grill and your must have beverages.
- A small cooler for ice and extra goodies (the mini fridge has a very small freezer).
- Don’t forget your favorite coffee creamer (if you use creamer).
- Be sure to pack items for S’mores around the fire pits.
- Firewood bundles (DNR approved wood ONLY for burning) can be purchased at the local Tofte General Store or gas stations.
- The kitchen will have everything you need to cook basic meals. Or, if you don’t want to cook you can eat at one of the local spots we recommend just minutes away.
- Beach Towels. If you plan to dip into chilly Lake Superior or even sun bath on your patio. The bath towels must stay in the cabins at all times.
Plan on packing a dog towel for wiping dog feet, bug spray, sunscreen, beach chairs for the mine lakes, umbrellas, additional games if you would like and anything else you might want on a ‘camping trip’!
For Winter:
-Traveling in the Winter?
-Remember the MN rule: always be prepared. Make sure your car is full of gas and has waterproof matches, extra blankets, extremely warm gear, etc just in case you need it.
-Pack your slippers, lots of layers and hand/foot warmers for your gloves and boots so you can enjoy exploring the North Shore for longer when it’s chilly out. Bring shoes/boots with good GRIP since it can get very slippery (especially walking down to the cabins). We do salt but be ice can melt/reform quickly in the Spring months!
-Packing Yak Tracks to slip over the bottom of your boots is KEY to ensuring SAFETY on our property along with exploring on foot in the Winter months. They can be purchased on Amazon for a very reasonable price.
-4 Wheel or All wheel drive vehicle might be needed for Winter months. We cannot guarantee immediate plows or assistance with getting stuck as help on the North Shore is limited.
During the months of October-May (and possibly beyond) you will want to plan on having a 4 wheel or all wheel drive vehicle along the North Shore and for your stay at Tofte Trails. We are only a short drive off of the main hwy 61 on Onion River Road. However, snow can come quickly and plows are limited on the North Shore. Please check the weather and remember to pack warm gear and plan accordingly. Extra blankets, extra warm jackets/gloves/snow pants, hand warmers, extra water, etc are all items that are important to keep in your vehicle while traveling in cold climates.

Tofte Trails is located in Cook County, Minnesota, in the United States. It is situated on the north shore of Lake Superior, which is the largest freshwater lake in the world by surface area. The area is surrounded by the beautiful natural landscapes of the Superior National Forest and is a popular destination for outdoor enthusiasts.
We LOVE Winter in Tofte and all along the entire North Shore. It is a season which is fully embraced by both locals and visitors. We are only about a 5 minute drive to Lutsen Mountain Ski Hill where you can ski/snowboard the best runs in the state of MN. Staying at Tofte Trails allows you to be in the perfect location for prime Winter adventures. We are just a short drive up to Oberg Mountain where you can access one of the best xcountry ski trails in the state: Sugarbush trailhead. Every season on the North Shore brings incredible beauty and amazing outdoor adventures. Spring is an especially special season as the snow melts and creates stunning, large waterfalls all along the North Shore. Parking is limited and unfortunately we cannot accommodate more than one vehicle per booking and we do not have space for trailers or boats. We built Tofte Trails in the forest and our goal was to leave as many trees as possible and not to clear cut a large parking opening. Please remember there is a short walk to your cabin from the parking area. We provide luggage carts for your use.

Did you know that Cook County is the best place in the lower 48 to see the Northern Lights? Cook County has an amazing website loaded with photography info, where to view the lights, driving routes, apps to alert you of upcoming activity and more! It's one of the most special and spectacular shows you will witness from Mother Nature. Late Fall and Winter tend to bring more activity but it can happen any time.

Children Policy

Dog Accommodations
Well-behaved owners may accompany their dogs for an additional pet fee and must be staying in a pet friendly cabin ONLY. The dog MUST be on the reservation if they are to be on the grounds. Guests who plan on bringing their dog must read our Dog Policy below before checking into Tofte Trails or you may risk the chance of being asked to leave without a refund.
Pet Policy:
PET RULES: IMPORTANT PLEASE READ: We do allow 1 well behaved dog per reservation in our pet friendly cabins only (no exception for 2 dogs unless discussed and approved via phone and email prior to stay). Puppies NOT allowed (must be over 1 year old) and the dog must be fully trained. They must be on the reservation and there is an additional pet fee. Dogs are NOT allowed on the beds unless they stay on the designated pet blanket. Please also remember to bring your dog's favorite bed!
You will be charged an additional cleaning fee if you let your dog on white bedding and he/she is dirty. This also includes allowing your dog in the cabin with muddy/dirty feet for our rugs. You will also be charged for ANY pet damages including but not limited to: chewing, scratching the doors, glass, etc. Please remember to pack a pet towel to wipe down wet fur/feet.
Your pet MUST be crated if left alone in the cabin. Please do not bring your dog if they are prone to barking. Cabins and patios are close to other guests and possibly other dogs. You will be asked to leave without a refund if your dog is aggressive or disturbing other guests. Please bring a towel for their feet for when they come back in the cabins. There will be a pick up station for you to use to pick up after your dog.
Your dog must be on a 6ft leash while on the property at all times. No exceptions.
We appreciate your understanding and willingness to only bring your dog if you can abide by the pet rules.
NON ‘DNR APPROVED WOOD’ BURNING IS NOT ALLOWED
-As a guest at Tofte Trails, you are asked to BYOW (bring your own wood) if you would like to have a bonfire.
--DNR Approved wood is available for purchase at both the local gas station and Tofte General Store. Please comply with this rule and be a good neighbor
-ALWAYS check the MN DNR website to check for any burn bans prior to burning.
-ALWAYS stay with your fire and never leave it unattended
-If you choose to make a fire during a non-ban time, you are REQUIRED TO PUT IT OUT FULLY
Cooking Options
No unit has an oven. There is a mini-fridge and 2 burner stove in every cabin along with a grill on the patio.
Tofte Trails is a Non-smoking Property
If you smoke inside your accommodation, a minimum cleaning fee of $450.00 will be charged to your account. The non-smoking policy refers to cigarettes, cigars, cannabis, e-cigarettes, and burning of candles (other than candles we provide) or incense. Smoking is NOT permitted on your cabin patio or in the forest. You may smoke by the driveway entrance only and FULLY put out your butts prior to properly disposing of them. If you are littering or smoking in an undesignated area, you will be subject to a fine.
Camping Onsite
Tofte Trails is a hotel with specific rooms associated with each reservation. No pitched tents, easy ups, pop-up shades, or RVs are allowed on the property or in the parking lot.

Cancellation Policy
All reservation changes and cancellations are subject to a $100.00 fee.
To receive a full refund less the $100 cancellation fee: Guests must cancel at least 30 days prior check-in by sending an email from the email on the reservation only.
If guests cancel within 14-30 days prior check-in: Guest will be refunded 50% for all nights less the $100 cancellation fee.
If guests decides to cancel (or modify dates) within 14 days of check-in: Refunds & modifications to a reservation within 14 days are not available. If you are concerned about Covid-19, weather (especially during Winter months on the North Shore) or a potential emergency, we recommend purchasing Trip Insurance.

Minimum Stay Requirements
Most reservations require a 2-3 night minimum stay. Holiday and Event weekends may require a 3-plus minimum night stay.
Damage and Missing Items
Any damaged or missing items by you or your guests discovered in your accommodations, as a result of your stay at Tofte Trails, will be assessed and billed accordingly to your credit card.
Taxes and Fees
All accommodations are subject to applicable taxes based on the nightly room rate.

Tofte Trails is not responsible for lost, stolen, or damaged articles. Report any problems with Tofte Trails immediately. We adhere to and maintain all state, county and local laws. The legal drinking age in Minnesota is 21 years. ID is required by all persons consuming alcoholic beverages.

Release and Waiver of Liability Agreement WHEREAS, Still Group LLC & Still Group Resorts LLC dba Still Resorts, LLC, the subsidiaries Cuyuna Cove, LLC & Tofte Trails LLC in addition to all properties under the Still Group LLC brand (“Company(s)”) sauna use, equipment rentals, yoga classes, experiences, guided tours, retreats and events (the “Activities”) and are willing to permit the individuals (the “Guests”) signing this Agreement to participate in the Activities, upon the terms and conditions of this Agreement. All or some of the Activities may take place on the Company’s premises or property(s) (the “Premises”) located at Crosby, MN, Tofte, MN, including “Offsite” locations. The Company and Guests may be collectively referred to as (the “Parties”). By selecting the “I agree” box at checkout, you are providing an electronic signature and are bound by all terms and conditions stated in this document and you are releasing Still Group LLC and all its subsidiaries of liability. THIS AGREEMENT IS VALID UPON SELECTING THE “I AGREE” BOX AT CHECKOUT & NOT READING THIS AGREEMENT DOES NOT NULLIFY ITS CONTENT.In consideration for being provided the ability to participate in the “Activities” and enter the Premises, each person hereby stipulates and agrees to the following. 1.Use of Premises for the Activities Only. I understand and agree that I may only use the Premises for the Activities set forth in this Release and Waiver of Liability agreement at the date(s) and time(s) permitted by the Company, and at all times shall abide by the Rules and Guidelines attached hereto in Appendix A. I further agree that I am responsible for the proper use and care of the Premises and any of Company’s property thereon, and that I will be liable for the replacement cost of any Company property/equipment which is damaged, destroyed or lost. 2.Assumption of Risk. I understand and acknowledge that the Activities I want to participate in may be dangerous and may involve the risk that I will sustain serious injury, temporary or permanent disability, death, and/or property damage. I understand that the Activity may not be supervised and that the Company(s) does not provide medical services. I further acknowledge that any injury I may sustain while participating in the Activities may be compounded by negligent or delayed medical service or negligent or delayed assistance by the Company(s). Injury due to acts of mother nature; wild life (bears and the like), falling limbs or downed trees causing bodily harm or death is not the responsibility of the Company(s) and you release all liability. I VOLUNTARILY AND FREELY ASSUME ALL RISKS AND DANGERS THAT MAY OCCUR PURSUANT TO MY USE OF THE PREMISES AND PARTICIPATION IN ACTIVITIES ON THE PREMISES, INCLUDING THE RISK OF INJURY, DEATH, OR PROPERTY DAMAGE, EVEN IF CAUSED BY NEGLIGENCE OF THE COMPANY(s) OR A THIRD-PARTY. 3.Release from Liability. I hereby agree, on behalf of myself, my heirs and my personal representatives, to fully and forever discharge and release Company(s) and its affiliates, and their respective partners, agents, operators, managers, employees, and representatives (“Released Parties”) from any and all claims I may have or hereinafter have for any injury, temporary or permanent disability, death, damages, liabilities, expenses and/or causes of action, now known or hereinafter known in any jurisdiction in the world, attributable or relating in any manner to my entry upon and use of the Premises and participation in the Activities, whether caused by the negligence of the Company(s) or any of the Released Parties or by any third-party or by any other reason. I acknowledge and agree that this Release and Waiver of Liability for a Potentially Dangerous Activity is intended to be, and is, a complete release, as much as allowed by law, of any responsibility of the Released Parties for all personal injuries, temporary or permanent disability, death, and/or property damage sustained by me while on or using the Premises or participating in the Activities.*Additionally Stated: In consideration of the services of the Still Resorts, LLC and Kelsey Braun, Christopher Austin and their agents, owners, officers, volunteers, contractors, participants, employees, lessors and all other persons or entities acting in any capacity on their behalf (hereinafter collectively referred to as “Company(s)”), I hereby agree to release and discharge the Company(s) on behalf of myself, my children, my parents, my heirs, assigns, personal representative and estate as follows:A. I acknowledge that staying at any Still Resorts property entails known and unanticipated risks which could result in physical or emotional injury, paralysis, death, or damage to myself, to property, or to third parties. I understand that such risks simply cannot be eliminated without jeopardizing the essential qualities of the activity.B. I expressly agree and promise to accept and assume all of the risks existing in this activity. My participation in this activity is purely voluntary and I elect to participate in spite of the risks.
C. I hereby voluntarily release, forever discharge, and agree to indemnify and hold harmless the Company(s) from any and all claims, demands, or causes of action, which are in any way connected with my participation this activity or my use of Still Resorts facilities, including any such claims which allege negligent acts or omissions of the Company(s).D. I further agree to relinquish and release all the Company(s) lessors, their officers, employees from all claims which the undersigned may have or hereafter accrue arising out of any occurrence upon or related to the premises of lessor upon which activity occurs.E. Should the Company(s) or anyone acting on their behalf be required to incur attorney’s fees and costs to enforce this agreement, I agree to indemnify and hold them harmless for all such fees and costs.F. I certify that I have adequate insurance to cover any injury or damage I may cause or suffer while participating, or else I agree to bear the costs of such injury or damage myself. I further certify that I have no medical or physical conditions, which would interfere with my safety in this activity, or else I am willing to assume and bear the costs of all risks that may be created, directly or indirectly, by any such condition. By booking my reservation with Still Resorts, aka the Company(s) I have agreed and I acknowledge that if anyone is hurt or property is damaged during my participation in activity, I may be found by a court of law to have waived my right to maintain a lawsuit against Still Resorts, its subsidiaries; effectively the “Company(s)” on the basis of any claim from which I have released him or her herein. I have had sufficient opportunity to read this entire document. I have read and understand it and I agree to be bound by its terms.4.Covenant Not to Sue. I agree, for myself and all my heirs, not to sue the Released Parties “Company(s)” or initiate or assist in the prosecution of any claim for damages or cause of action against the Released Parties which I or my heirs may have as a result of any personal injury, death or property damage I may sustain while on or using the Premises or while participating in the Activities. 5.Indemnification. I hereby agree to defend, indemnify and hold harmless the Company(s) and the Released Parties from and against any third-party losses, damages, actions, suits, claims, judgments, settlements, awards, interest, penalties, expenses (including reasonable attorneys’ fees) and costs of any kind for any personal injury, loss of life or damage to property sustained by reason of or arising out of my use of the Premises or participation in any Activities on the Premises. 6.Medical Treatment Release. I hereby authorize the Company(s) to secure, and I consent to, any medical treatment that may be given to me should the Company(s) determine, in its sole discretion, that I need medical care, as a result of my being on the Premises or from participating in the Activities. I accept full responsibility for all costs related to my medical treatment, including any transport costs, and I release all parties involved from any type of liability for anything that may happen during my treatment or transport. 7.Responsibility for Personal Property and Property of Still Resorts. I acknowledge and agree that I am fully and solely responsible for any of my property and personal belongings and pet (dog) that I bring onto the Premises or that I use during the Activities, and that the Company(s) will not be responsible for or provide any security for my property, pets (dogs) and personal belongings. Nor will the Company(s) be responsible for stolen property nor shipping lost or forgotten items to Guests. Guests will be responsible for the replacement, at full current value, and loss-of-use of any equipment rented under this form which is lost, stolen, damaged, or otherwise not returned to The Company(s). I agree to return all rental equipment by the agreed time and date or I shall incur a late fee. 7b) Pet agreement upon booking: Well behaved dogs only allowed in select accommodations. No other animals permitted on the properties. The pet fee is non-refundable. Any dog must be crated if left alone in a cabin for ANY amount of time. No exceptions. If your dog is too large to crate, he/she must go with you at all times. Dogs must be over the age of 1 year and fully trained. No puppies allowed. Please note:If you attempt to bring your dog and he/she is NOT on the reservation you will be subject to a $200 fee in addition to the nightly pet rate. 1dog permitted in select cabins only. You are required to report any damages to your cabin within one hour of arrival or you will be held responsible. We hope to stay pet friendly for years to come, but in order to do so the following rules must be followed by our guests and pet owners. -When booking your reservation at Tofte Trails, you are agreeing to the following pet rules:• Your dog must be on the reservation and the pet fee paid prior to arrival (High end blankets are removed from the beds for pet reservations)• You must book a pet friendly cabin in order to bring your dog• Dogs are NOT allowed on the beds (be sure to bring a dog bed with)• Dogs must never be left alone in cabin unless secured in a crate. You will be asked to bring your own or rent one from us prior to your arrival. You may be asked to show proof of a crate by sending us a photo within 1 hour of arrival. • Do not bathe/shower your pet in the cabin showers. There will be an additional cleaning fee. There is a 'dog wash' station up the road from us at the laundromat/carwash located behind Red Raven.• Owners are required to pick up after the dog and properly dispose of the waste in the garbage bin. • Please bring a dog towel to wipe dirty feet before entering the cabin• Dogs must be on a 6ft leash on the property at ALL times• Dogs are not allowed to be left on the patio alone if you leave the cabin*Owners must adhere to to all posted rules/regulations for dogs on state/local trails in every season. Not all trails are pet friendly.If your dog is prone to barking or may chew/scratch anything in the cabin, we ask that you leave them at home so we can continue to offer dog friendly accommodations. You will be charged for any damage. If your dog is barking, aggressive or disruptive to other guests we reserve the right to ask you to leave without refund. Tofte Trails reserves the right to ask you to leave without a refund if any of the above policies are not adhered to.A. Your card on file will be charged for any minor or major damage to the accommodation(s) and all items therein and additionally for any “lost” or “stolen” items. Replacement of items may result in additional restocking fees as well as reimbursing the staff members’ time to complete the task. You’ll also be charged for sneaking additional guests and pets without notice into the property. IF you decline the charge via your credit card company you may be subject to small claims court no matter the cost and be liable to pay all attorney(s) and court fees. *Inventory is taken prior to your arrival and after your departure. Stating that you "did not do it" or that "it broke" will not constitute a release of responsibility or liability. 8.No Representations by Company. I acknowledge that the Company(s) makes no representation as to the condition of the Premises or the safety of the Activity or any equipment either on the Premises or used in the Activities. I accept and shall use the Premises, and its equipment, in its “AS IS” condition. Governing Law and Venue. This Release and Waiver of Liability agreement will be governed by and interpreted in accordance with the laws of the State of Minnesota, without giving effect to the principles of conflicts of law of such state. I agree that any action arising out of this Release and Waiver of Liability agreement must be brought exclusively in any state or federal court located in Cook County, Minnesota or Crow Wing County, Minnesota. 10.Waiver. No waiver of any term or right in this Release and Waiver of Liability agreement shall be effective unless in writing, signed by an authorized representative of the waiving party. The failure of any party to enforce any provision of this agreement shall not be construed as a waiver or modification of such provision, or impairment of its right to enforce such provision or any other provision of this agreement thereafter. 11.Survival. Any provision of this Release and Waiver of Liability agreement providing for performance by either party after termination of this agreement shall survive such termination and shall continue to be effective and enforceable. 12.Compliance with Laws. In the performance of the terms of this Release and Waiver of Liability agreement and use of the Premises, the Parties shall comply with all applicable federal, state, regional and local laws, rules and regulations. 13.Severability. If any provision or portion of this Release and Waiver of Liability agreement shall be held by a court of competent jurisdiction to be illegal, invalid, or unenforceable, the remaining provisions or portions shall remain in full force and effect. 14.Entire Agreement; Modification; Binding Effect. This Agreement is the entire agreement between the parties with respect to the subject matter hereof and supersedes any prior agreement or communications between the parties, whether written, oral, electronic, or otherwise. No change, modification, amendment, or addition of or to this agreement shall be valid unless in writing and signed by authorized representatives of the Parties. This agreement shall be binding upon and inure to the benefit of the successors, assigns, and legal representatives of the parties. 1. Guests must be age 21+ to reserve a stay are required to read all emails, communications sent by the Company(s) and abide by all cabin/tent/property/sauna rules.2. Pets (dogs only) allowed in specified accommodations: Please refer to FAQ page for PER PROPERTY pet rules as they are unique to specific accommodations. Guests are subject to additional fees if pet rules are violated. If a pet is allowed, it must be on the reservation PRIOR to your arrival or you will be subject to an additional fee. By booking, you are agreeing to our pet policies listed in our FAQs and will be asked to leave without a refund if you choose to not abide by the posted rules. 3. Sauna: A swimsuit or athletic attire is required to be worn in the saunas at all times. Guests must sit on a towel while in the sauna for hygienic purposes. A towel will be provided for private sauna guests. Sauna guests should never touch the sauna stoves and rocks and should always stay at least one foot back from the sauna stove pedestal. Aromatherapy may be used during sauna sessions. If you have a sensitivity to aromatherapy fragrances do not use them in the sauna. Guests are allowed to control the sauna temperature controls at their own risk. Additional rules may be posted on the sauna at the property. 4. Guests should not enter the sauna after consuming alcohol or other drugs. 5. The consumption of drugs on the premises is strictly prohibited. The Company(s) do not allow smoking of any kind on the properties unless noted for a designated area. Absolutely no smoking IN or around your accommodation or a fine will be assessed upon the incident. Any remediations as a result of smoking damage will be charged to you. 6. Guests are responsible for starting and fully putting out a fire in the bonfire pits. You will be held liable for any fire related damage to the properties assets and the surrounding Premises and not limited to the surrounding area. IF you cause a forest fire you will be held liable for all damages. DO NOT THROW BURNT LOGS INTO THE WOODS AND NEVER LEAVE YOUR FIRE UNATTENDED. DNR approved wood for burning ONLY. Additional DNR approved wood is available for sale at the local grocery store (Super One) or at the gas stations. You are welcome to burn charcoal and DNR approved wood, but due to local/state regulations and conditions, we are not permitted to burn non DNR approved wood or trash. At times, due to severe high fire danger or other local conditions circumstances may prohibit the use of fire pits, grills or wood stoves. Guests are responsible for checking these restrictions and monitoring present day conditions prior to burning. 6b. Guests are responsible to use gas stoves and gas stove tops correctly and abide by all rules. Guests will be held responsible for any damage caused due to negligence. 7. Rudeness, racism, sexism, etc to staff or other guests will not be tolerated and you may be asked to leave the property without a refund. 8. Guests should not enter the facilities if they are not feeling well or have been exposed to someone who is ill. 9. Consult a doctor before utilizing saunas if you are pregnant or are on any medications. 10. IF children are permitted to the Premises you are solely responsible for their access to the facilities including but not limited to the sauna(s) and you release the Company(s) of any liability for any injury or harm that may occur. It is recommended that children under the age of 10 do not enter the sauna(s).11. Be aware that sauna sessions, experiences; mountain biking, hiking, paddle boarding, kayaking, canoeing, snowshoeing, altai skiing, fat tire biking, ice skating (non exhaustive list), activities, retreats, yoga classes and the like will likely have other guests sharing the Activities and facilities with you. 12. Guests’ time on the premises is limited to the allotted time of their booking stay. Please be respectful of other guests. You may not stay beyond your reservation to utilize the facilities, equipment and or sauna(s). Activity based experiences may take place at an hour or be rescheduled at a time not within your reservation booking window to which you may attend the experience prior to your departure. All experiences will take place during your booking window reservation weather permitting. IF weather dictates the experience you will be refunded for any cancellation on behalf of the Company(s). You will not be refunded for canceling the experience based on your discretion as experiences are scheduled with staff or contractors in advance based on your selection at time of booking or any last minute experience bookings.13. At Still Resorts “The Company(s)” we value everyone as unique individuals. As such, we have a strict non-discrimination policy. We believe everyone should be treated equally regardless of race, sex, gender identification, sexual orientation, national origin, native language, religion, age, disability, marital status, citizenship, genetic information, pregnancy, or any other characteristic protected by law. Discrimination and rude, crude, or lewd behavior against other guests or our staff is strictly prohibited and you may be subject to criminal and or civil penalties in the result of litigation or lawsuit. **I HEREBY ACKNOWLEDGE THAT I HAVE FULLY READ AND UNDERSTAND EACH OF THE ABOVE PROVISIONS AND THAT I UNDERSTAND I AM GIVING UP SIGNIFICANT LEGAL RIGHTS, INCLUDING THE RIGHT TO SUE THE COMPANY.
